New York’s Cannabis Control Board has extended the provisional license period for covered Conditional Adult-Use Retail Dispensary (CAURD) and adult-use retail dispensary provisional licensees through December 31, 2028. The Board adopted Resolution 2026-77 on October 1, replacing the prior common December 31, 2026 deadline.

Last verified: November 2, 2026

Quick Take

  • New deadline: December 31, 2028.
  • Covered categories: provisional CAURD and provisional adult-use retail dispensary licensees.
  • The resolution includes qualifying provisional licenses issued through December 31, 2027. OCM’s October 1 guidance lists December 31, 2026 instead; see below.
  • Covered licensees must submit a completed post-selection application to OCM by the new deadline, according to OCM’s provisional license guidance.
  • Provisional status should not be described as authorization to begin retail operations.

What Changed

Resolution 2026-77 states that the Office of Cannabis Management recommended extending the provisional period to give licensees more time to submit outstanding information required for final license approval. The Board agreed and moved the deadline to December 31, 2028.

The resolution also reaches forward: the Office’s recommendation, which the Board adopted, covers provisional licenses issued until December 31, 2027.

One Date to Confirm With OCM

OCM’s Provisional License Policy Guidance, also issued October 1, 2026, describes the same Board action differently. It says the extension applies to provisional licenses issued as of September 9, 2025, and to those issued between September 9, 2025, and December 31, 2026. It does not mention licenses issued in 2027.

Both documents agree on the December 31, 2028 deadline and the covered license types. Applicants who receive a provisional license during 2027 should confirm with OCM how the extension applies to them.

What OCM Says Licensees Must Do

According to OCM’s guidance, covered licensees must submit a completed post-selection application to the Office by December 31, 2028. The post-selection application is submitted through the New York Business Express portal and must include proof of control over the proposed retail location, such as a lease or deed. OCM states that it will not review location submissions sent by email.

  • If a provisional licensee does not submit the post-selection application by the deadline, the provisional license expires and the applicant cannot move forward to a final license. OCM will not accept post-selection applications after the deadline.
  • If a complete post-selection application is submitted before the deadline, OCM will continue processing it until there is a final determination.
  • OCM says provisional licensees should expect this extension to be the last and plan accordingly. The Office and Board may extend an individual licensee’s period case by case for good cause.

Who Is Affected

The action directly affects covered provisional CAURD and adult-use retail dispensary licensees that still need to complete the steps required for final approval. It also matters to landlords, lenders, investors and service providers working with provisional businesses because the regulatory runway for completing final licensure has changed.

What the Extension Does Not Do

The Board’s action extends the period for completing outstanding final-approval requirements. It does not say that a provisional license is a final operational license, and it does not automatically alter private leases, financing agreements, construction schedules or other contracts. Those obligations must be evaluated separately.

What Provisional Licensees Should Do Next

  • Confirm that the specific provisional license is covered by Resolution 2026-77, particularly if it was issued after December 31, 2026.
  • Plan to submit a complete post-selection application, with proof of location control, well before December 31, 2028.
  • Continue working through OCM’s outstanding final-approval requirements rather than treating the extension as a reason to stop progress.
  • Review location-control, financing, buildout and other private timelines independently; the Board resolution does not automatically extend them.
  • Keep records of OCM deficiency requests and submissions related to final approval.

Empire Bud Academy Analysis

The extension reduces a significant regulatory timing risk for covered provisional retailers, but it should be understood as additional runway rather than a reset of the licensing process. Operators still need a viable path to final approval. For businesses with unresolved locations, financing or buildout issues, the added time may improve planning flexibility, but it does not solve those issues by itself.
