New York Cannabis Nursery License Applications Open November 5: Only 50 Applications Accepted

New York is preparing to open its adult-use cannabis nursery license application window November 5, with the first round limited to 50 submissions. Prospective applicants should prepare now—but several implementation details still require final OCM confirmation.

New York is opening a limited application round for adult-use cannabis nursery licenses on November 5, 2026, and the window will close as soon as the Office of Cannabis Management receives 50 submissions through its application portal. The Cannabis Control Board approved the application period in Resolution 2026-76 on October 1.

For prospective nursery operators, the practical message is straightforward: this is not a conventional application window with a fixed closing date. The controlling resolution ties the close of the round to the number of submissions received.

Quick Take

  • Opening: November 5, 2026 at 10:00 AM EST, through New York Business Express (NYBE), according to OCM’s nursery guidance.
  • Cap: the first 50 submissions into OCM’s application portal.
  • Submissions after the first 50 are not considered filed, and their application fees are to be returned.
  • Labor peace: OCM’s nursery guidance still lists a Labor Peace Agreement, but legislation signed October 28 removed that statutory licensing condition. See the section below.
  • A nursery license is a specialized adult-use license for the regulated propagation side of the supply chain.
  • Applicants should rely on OCM’s final application and portal instructions rather than draft or third-party checklists.

What the Cannabis Control Board Approved

Resolution 2026-76 approves certain nursery application forms and establishes the new application period. The resolution states that the window opens November 5 and closes upon the submission of 50 applications into OCM’s portal. It also states that applications arriving after the initial 50 will not be considered filed with the Office and that their application fees will be returned.

That makes submission readiness unusually important. It does not mean that being among the first 50 guarantees a license. Applicants still must satisfy the applicable statutory, regulatory and application requirements.

What a New York Cannabis Nursery License Covers

New York’s adult-use framework treats nursery licensing as a distinct part of the regulated cultivation supply chain. Cannabis Law Section 75 and the adult-use regulations govern the scope and restrictions of the license. The regulations identify outdoor, mixed-light and indoor nursery types, with different maximum nursery areas.

According to OCM’s nursery guidance, nursery licensees may sell seeds, clones, immature plants and other agricultural products used for cannabis cultivation to eligible State-licensed cannabis businesses, including cultivators, microbusinesses, cooperatives, registered organizations and other licensed nurseries. The license does not authorize sales of seeds, clones or immature plants directly to consumers or home growers.

The current regulations also require nursery applicants to obtain a Nursery Grower Certificate of Registration from the New York State Department of Agriculture and Markets Division of Plant Industry before licensure by the Cannabis Control Board.

How to Apply and What OCM Says You Will Need

Applications are filed through New York Business Express (NYBE) using a NY.gov account. OCM states that the NYBE application has a save-and-resume feature and that applicants can log in after submission to check their application status. Applications are accepted and reviewed in the order received, and only the first 50 will be considered for this round.

OCM’s nursery guidance lists the following eligibility requirements and preparation items:

  • A Nursery Grower Certificate of Registration from the New York State Department of Agriculture and Markets. OCM notes the registration costs $100 and lasts two years.
  • Proof of control over the proposed nursery location, such as a lease or deed, plus a certificate of occupancy or its equivalent.
  • Ownership and business information, including the applicant entity’s capitalization table and a certificate issued by the New York Department of State.
  • Documentation for Social and Economic Equity status, if applying as an SEE applicant.
  • A Labor Peace Agreement with a bona fide labor organization. See the next section for the October 28 statutory change.

OCM also states that a nursery licensee and its True Parties of Interest cannot hold an interest in a retail dispensary, delivery or on-site consumption license, and that all nursery licensees must track cannabis through the state’s seed-to-sale system. After the 50 applications are received, OCM’s Licensing Unit begins review with a 30-day cure period for deficiencies, and OCM anticipates sending applications to the Cannabis Control Board within several months. A license requires Board approval.

Labor Peace Agreements After S10643

As of October 29, 2026, OCM’s nursery guidance continues to list a Labor Peace Agreement among the eligibility requirements. On October 28, 2026, Governor Kathy Hochul signed S10643, which repealed the Cannabis Law provisions that had made labor peace agreements a licensing condition. According to the bill’s effective-date terms, those changes took effect immediately.

OCM had not published updated nursery guidance addressing the change when this article was last verified. Applicants should check OCM’s nursery page and the NYBE application before filing, follow the requirements OCM presents at the time of submission, and consult qualified counsel about how the change affects their application.

What Applicants Should Do Before November 5

OCM’s current adult-use license fee schedule lists a $1,000 application fee for most license types. For nursery licenses, the listed license fees are $750 for Outdoor, $1,000 for Mixed-Light and $2,000 for Indoor. Qualified Social and Economic Equity applicants receive a 50% reduction in application and license fees. Although OCM’s general fee schedule describes the application fee as nonrefundable, CCB Resolution 2026-76 specifically states that fees will be returned for submissions received after the nursery application portal reaches the 50-application cap.

  • Create or confirm a NY.gov account for New York Business Express (NYBE) before 10:00 AM EST on November 5.
  • Review Article 4 of the Cannabis Law and Part 123 of the adult-use regulations for ownership and license restrictions.
  • Confirm which nursery type fits the proposed operation and location.
  • Prepare ownership, entity, premises and other documents required by the final OCM application.
  • Do not rely on a draft fee schedule or third-party application screenshot as the controlling filing instruction.

What Is Still Unresolved

Resolution 2026-76 and OCM’s nursery guidance establish the opening date and time, the 50-submission cap and the NYBE filing process. The main open question is how OCM will treat the Labor Peace Agreement item after S10643. Empire Bud Academy is watching for updated OCM guidance and will update this article if the application requirements change.

Empire Bud Academy Analysis

The defining feature of this round is not simply that New York is activating another license type. It is the submission-based cap. That changes the preparation problem for applicants: documents, entity structure, premises strategy and portal readiness need to be addressed before the window opens rather than during a long filing period. At the same time, speed should not be confused with eligibility or approval. A fast submission that does not satisfy the controlling requirements is not a substitute for a complete, supportable application.
